Welcome to HopeWave Foundation (“HopeWave”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website, applications, and related services (collectively, the “Services”). Please read them carefully.
1. Acceptance of terms
By creating an account, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You may use the Services only if you:
- Are at least 18 years of age, or the age of majority in your jurisdiction;
- Have the legal capacity to enter into a binding contract;
- Are not barred from using the Services under any applicable law; and
- Provide accurate, current, and complete information when registering.
3. Accounts and registration
To use most features of the Services, you must register for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at our contact page if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms, contain false information, or are used to engage in fraudulent activity.
4. Campaigns and content
HopeWave allows users (“Creators”) to create fundraising campaigns. By publishing a campaign, you represent and warrant that:
- All information provided is accurate, complete, and not misleading;
- You have the legal right to raise funds for the stated purpose;
- If raising funds for a beneficiary other than yourself, you have that beneficiary’s consent;
- You will use funds raised solely for the purpose described in the campaign; and
- Your campaign complies with all applicable laws.
You retain all rights in the content you submit. By submitting content, you grant HopeWave a worldwide, non-exclusive, royalty-free license to host, reproduce, display, and distribute the content for the purpose of operating and promoting the Services.
5. Donations and payments
Donations made through the Services are processed by third-party payment processors (such as Stripe, Inc.). By making a donation, you agree to the payment processor’s terms in addition to these Terms.
Donations are generally non-refundable. However, if a campaign is found to violate these Terms or applicable law, we may, at our discretion, return funds to donors.
Donors acknowledge that HopeWave is not responsible for how a Creator uses funds received through a campaign and makes no representation that any campaign will achieve its stated goal.
6. Fees
HopeWave may charge platform fees and pass-through payment processing fees on each donation. All applicable fees will be disclosed clearly before a donation is confirmed. We reserve the right to update our fee structure with notice posted on our website.
7. Withdrawals and verification
Before withdrawing funds, Creators must complete identity verification, which may include providing a government-issued ID, proof of address, and bank account information. Verification is performed by us or our payment processor in accordance with applicable anti-money-laundering and know-your-customer laws.
We reserve the right to delay, hold, or reject withdrawals if we suspect fraud, policy violations, or to comply with legal obligations.
8. Prohibited conduct
You agree not to use the Services to:
- Violate any law, regulation, or third-party right;
- Submit false, misleading, or fraudulent information;
- Promote violence, hate, harassment, or discrimination;
- Misrepresent the purpose of a campaign or the use of funds;
- Raise funds for activities involving weapons, illegal substances, or other prohibited goods;
- Circumvent the Services’ security measures or interfere with their normal operation;
- Use the Services to transmit malware or to engage in phishing.
9. Intellectual property
The Services, including all software, design, text, graphics, and trademarks (other than user-submitted content), are owned by HopeWave or its licensors and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the Services without our prior written consent.
10. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
HopeWave does not endorse any campaign or Creator and makes no representations about the accuracy, completeness, or reliability of any campaign content.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOPEWAVE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
12. Indemnification
You agree to indemnify and hold harmless HopeWave, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Services, your content, or your violation of these Terms.
13. Termination
We may suspend or terminate your account and access to the Services at any time, with or without notice, if we believe you have violated these Terms or applicable law. You may terminate your account at any time by following the instructions on the Services.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Services will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
15. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Effective date” at the top of this page and, for material changes, notify you by email or through the Services. Your continued use of the Services after any update constitutes acceptance of the revised Terms.
